Terms of Use

These terms are the agreement between you and Dukkanty (the website dukkanty.com and the Dukkanty apps for iPhone and Android, run by Jo-Vision). By using Dukkanty you accept them. If you do not accept them, please do not use Dukkanty.

What Dukkanty is

Dukkanty lets a shop owner scan their shop with a phone and publish it as a 3D walk-through that shoppers can visit online. Shoppers can walk the aisles, find products, chat with the shop and order to pick up in store. Shop owners also get a point of sale that works offline.

Your account

You must be at least 13 years old to use Dukkanty, and old enough in your country to make a binding agreement to run a shop on it.
Keep your sign-in safe. You are responsible for what is done with your account.
The information you give about yourself and your shop must be true.

Shop owners

Scan and publish only a shop you own or are allowed to show.
You are the seller. You are responsible for your products, prices, stock, orders, taxes and the law that applies to your shop. Dukkanty is not a party to sales between you and your shoppers.
Before you publish a scan, check it. Do not publish people's faces, documents, screens, card details or anything private that the camera caught. You can remove photos from a scan in the app.
Product names made for you automatically may be wrong. Check them before you rely on them.

Shoppers

Orders are placed with the shop, not with Dukkanty. Prices, availability, pickup and returns are the shop's.
A 3D walk-through shows the shop as it was when it was scanned. What is on the shelf today may differ.

Copyright: who owns the scans and images

Your scans are yours. The photos, 3D scans, depth data, product pictures and other content a shop owner records or uploads (your content) stay the property of that shop owner. Dukkanty does not claim ownership of them.

So that we can run the service, you give Dukkanty a worldwide, non-exclusive, royalty-free licence to store, copy, process, resize, convert and show your content, and to make from it the 3D walk-through, maps, product outlines, product names and thumbnails, only to provide and improve Dukkanty and to show your shop to the people you publish it to. This includes showing your published shop and its pictures on dukkanty.com, in the apps, in share links and previews, and in search results about your shop. The licence ends when you delete the content or your account, except for copies already shared by others, backups kept for a short time, and what the law requires us to keep.

You promise that you have the right to give us this licence: the shop is yours or you have permission to film it, and the content does not break anyone else's rights. Brands, logos and packaging that appear on products in your shop belong to their owners.

Dukkanty itself is ours. The Dukkanty name and logo, the apps, the website, the scanner, the 3D walk-through viewer and all their software, design and text are owned by Jo-Vision and protected by copyright and other laws. Using Dukkanty does not give you any right to them beyond using the service.

You may view, share the link to and talk about any published shop.
You may not download, copy, scrape, resell or republish another shop's scans, photos or product pictures, or use them to train AI models, without that shop owner's written permission.
You may not copy, take apart or rebuild the Dukkanty apps, viewer or scanner, or remove copyright notices.

Reporting copyright infringement

If you believe a shop on Dukkanty shows your work, your shop or your property without permission, email us with: who you are, what is yours, the address of the page, and a statement that you believe the use is not allowed. We will look at it, may remove the content, and will tell the shop owner. Accounts that infringe again and again will be closed.

What is not allowed

Breaking the law, or selling illegal, stolen, counterfeit or dangerous goods.
Filming people in a way that breaks their privacy, or publishing places you have no right to show.
Fake shops, fake reviews, spam, or pretending to be someone else.
Attacking, overloading or getting around the security of Dukkanty, or reading data that is not yours.
Automated scraping of the website, the API or the walk files.

Plans and payment

Dukkanty Free is free, with the limits shown on the pricing page (dukkanty.com/pricing). Pro features may be paid; before you pay for anything we will show you the price and the terms of that plan. We may change what each plan includes, and will tell you before a change takes something away from a plan you pay for.

Removing content and accounts

You can delete your scans, shop and account at any time. We may hide or remove content, or suspend an account, that breaks these terms or the law, or that we are asked to remove by a court or authority. Where we can, we will tell you why.

The service as it is

We work to keep Dukkanty running and your data safe, but it is provided as it is and as available. We do not promise it will never stop, never have errors, or that a scan, a measurement or an automatic product name will be exact. Keep your own copy of anything important.

Limits of our responsibility

As far as the law allows, Dukkanty and Jo-Vision are not responsible for indirect or lost-profit damages, or for the products, orders, conduct or content of shops and shoppers. Nothing in these terms limits a responsibility the law does not allow us to limit.

Changes and law

We may update these terms. When we do, we will change the date at the top, and tell you in the app for important changes. Using Dukkanty after a change means you accept it. These terms are governed by the laws of the Hashemite Kingdom of Jordan, and its courts decide any dispute, unless the law of your country gives you other rights.

هذه الشروط هي الاتفاق بينك وبين دكانتي (الموقع dukkanty.com وتطبيقات دكانتي على آيفون وأندرويد، وتديرها Jo-Vision). باستخدامك دكانتي فإنك توافق عليها، وإن لم توافق عليها فالرجاء عدم استخدام دكانتي.

ما هو دكانتي

يتيح دكانتي لصاحب المتجر أن يمسح متجره بهاتفه وينشره جولةً ثلاثية الأبعاد يزورها المتسوقون عبر الإنترنت. يتجول المتسوق بين الممرات ويجد المنتجات ويراسل المتجر ويطلب ليستلم من المتجر. ويحصل صاحب المتجر أيضاً على نقطة بيع تعمل دون إنترنت.

حسابك

يجب ألا يقل عمرك عن 13 عاماً لاستخدام دكانتي، وأن تكون في السن التي تسمح لك بها قوانين بلدك بإبرام اتفاق ملزم لإدارة متجر عليه.
حافظ على أمان تسجيل دخولك، فأنت مسؤول عمّا يتم بحسابك.
يجب أن تكون المعلومات التي تقدمها عن نفسك وعن متجرك صحيحة.

أصحاب المتاجر

امسح وانشر فقط متجراً تملكه أو مسموحاً لك بعرضه.
أنت البائع، وأنت المسؤول عن منتجاتك وأسعارك ومخزونك وطلباتك وضرائبك والقوانين التي تنطبق على متجرك. دكانتي ليس طرفاً في البيع بينك وبين المتسوقين.
راجع المسح قبل نشره. لا تنشر وجوه الناس أو المستندات أو الشاشات أو بيانات البطاقات أو أي شيء خاص التقطته الكاميرا. يمكنك حذف صور من المسح في التطبيق.
قد تكون أسماء المنتجات التي تُنشأ لك تلقائياً خاطئة، فراجعها قبل الاعتماد عليها.

المتسوقون

تُقدَّم الطلبات إلى المتجر لا إلى دكانتي، والأسعار والتوفر والاستلام والإرجاع مسؤولية المتجر.
تُظهر الجولة ثلاثية الأبعاد المتجر كما كان وقت مسحه، وقد يختلف ما على الرفوف اليوم.

حقوق النشر: لمن تعود ملكية المسح والصور

مسحك ملك لك. تبقى الصور والمسح ثلاثي الأبعاد وبيانات العمق وصور المنتجات وغيرها من المحتوى الذي يسجله صاحب المتجر أو يرفعه (محتواك) ملكاً لصاحب المتجر، ولا يدّعي دكانتي ملكيتها.

لكي نتمكن من تشغيل الخدمة، تمنح دكانتي ترخيصاً عالمياً غير حصري ودون مقابل لتخزين محتواك ونسخه ومعالجته وتغيير حجمه وتحويله وعرضه، وإنشاء الجولة ثلاثية الأبعاد والخرائط وتحديد المنتجات وأسمائها والصور المصغرة منه، وذلك فقط لتقديم دكانتي وتحسينه ولعرض متجرك على من تنشره لهم. ويشمل ذلك عرض متجرك المنشور وصوره على dukkanty.com وفي التطبيقات وروابط المشاركة والمعاينات ونتائج البحث عن متجرك. ينتهي الترخيص عند حذفك المحتوى أو حسابك، باستثناء النسخ التي شاركها آخرون، والنسخ الاحتياطية المحفوظة لفترة قصيرة، وما يُلزمنا القانون بالاحتفاظ به.

أنت تتعهد بأن لك الحق في منحنا هذا الترخيص: المتجر لك أو لديك إذن بتصويره، والمحتوى لا يتعدى على حقوق أحد. العلامات التجارية والشعارات والعبوات الظاهرة على المنتجات في متجرك ملك لأصحابها.

دكانتي نفسه ملك لنا. اسم دكانتي وشعاره والتطبيقات والموقع والماسح وعارض الجولة ثلاثية الأبعاد وكل برمجياتها وتصميمها ونصوصها مملوكة لـ Jo-Vision ومحمية بقوانين حقوق النشر وغيرها. استخدامك دكانتي لا يمنحك أي حق فيها سوى استخدام الخدمة.

يمكنك مشاهدة أي متجر منشور ومشاركة رابطه والحديث عنه.
لا يجوز لك تنزيل مسح متجر آخر أو صوره أو صور منتجاته أو نسخها أو جمعها آلياً أو بيعها أو إعادة نشرها، أو استخدامها لتدريب نماذج ذكاء اصطناعي، دون إذن مكتوب من صاحب المتجر.
لا يجوز لك نسخ تطبيقات دكانتي أو عارضه أو ماسحه أو تفكيكها أو إعادة بنائها، ولا إزالة إشعارات حقوق النشر.

الإبلاغ عن انتهاك حقوق النشر

إذا كنت تعتقد أن متجراً على دكانتي يعرض عملك أو متجرك أو ممتلكاتك دون إذن، فراسلنا بالبريد الإلكتروني متضمناً: من أنت، وما الذي يخصك، وعنوان الصفحة، وإقراراً بأنك تعتقد أن الاستخدام غير مسموح. سننظر في البلاغ، وقد نزيل المحتوى، وسنُعلم صاحب المتجر. وتُغلق الحسابات التي تكرر الانتهاك.

ما هو غير مسموح

مخالفة القانون، أو بيع بضائع غير قانونية أو مسروقة أو مقلدة أو خطرة.
تصوير الناس بطريقة تنتهك خصوصيتهم، أو نشر أماكن لا يحق لك عرضها.
المتاجر المزيفة والتقييمات المزيفة والرسائل المزعجة وانتحال شخصية الآخرين.
مهاجمة دكانتي أو إثقاله أو تجاوز حمايته، أو الاطلاع على بيانات ليست لك.
الجمع الآلي للبيانات من الموقع أو الواجهة البرمجية أو ملفات الجولات.

الخطط والدفع

خطة دكانتي المجانية مجانية، بالحدود الموضحة في صفحة الأسعار (dukkanty.com/pricing). قد تكون ميزات Pro مدفوعة، وقبل أن تدفع لأي شيء سنعرض لك السعر وشروط الخطة. قد نغيّر ما تتضمنه كل خطة، وسنخبرك قبل أي تغيير يُنقص من خطة تدفع لها.

حذف المحتوى والحسابات

يمكنك حذف مسحك ومتجرك وحسابك في أي وقت. وقد نخفي أو نحذف محتوى أو نوقف حساباً يخالف هذه الشروط أو القانون، أو يُطلب منا حذفه من محكمة أو جهة مختصة، وسنخبرك بالسبب متى أمكن.

الخدمة كما هي

نعمل على إبقاء دكانتي يعمل وبياناتك آمنة، لكنه يُقدَّم كما هو وحسب توفره. لا نضمن ألا يتوقف أبداً أو ألا تحدث أخطاء، ولا أن يكون المسح أو القياس أو اسم المنتج التلقائي دقيقاً تماماً. احتفظ بنسختك من أي شيء مهم.

حدود مسؤوليتنا

في الحدود التي يسمح بها القانون، لا يتحمل دكانتي ولا Jo-Vision مسؤولية الأضرار غير المباشرة أو الأرباح الفائتة، ولا مسؤولية منتجات المتاجر والمتسوقين أو طلباتهم أو سلوكهم أو محتواهم. لا شيء في هذه الشروط يحدّ من مسؤولية لا يسمح القانون بالحد منها.

التغييرات والقانون

قد نحدّث هذه الشروط، وعندها سنغيّر التاريخ في الأعلى ونخبرك في التطبيق بالتغييرات المهمة. استمرارك في استخدام دكانتي بعد التغيير يعني موافقتك عليه. تخضع هذه الشروط لقوانين المملكة الأردنية الهاشمية، وتختص محاكمها بالنظر في أي نزاع، ما لم يمنحك قانون بلدك حقوقاً أخرى.
